WAIVER AND RELEASE OF LIABILITY
WARNING: Firearms, by their very nature, can be lethal. The RARE BREED TRIGGERS LLC (RBT) Forced Reset Trigger (FRT) may inadvertently cause INJURY or DEATH if misused. Improper use, misuse, or untrained handling of the FRT can lead to PROPERTY DAMAGE, PERSONAL INJURY to yourself or others, or even DEATH.
WARNING: NEVER RELY ON MECHANICAL FEATURES. IT IS YOUR RESPONSIBILITY TO ENSURE SAFE HANDLING OF ANY FIREARM, INCLUDING ANY FIREARM EQUIPPED WITH AN FRT.
WARNING: IT IS THE BUYER’S RESPONSIBILITY TO ENSURE THAT THEY ARE IN COMPLIANCE WITH ALL APPLICABLE LAWS AT ALL TIMES WHILE USING THIS PRODUCT. SOME STATES MAY RESTRICT OR PROHIBIT THE USE OF THE FRT BY CIVILIANS.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISK: The FRT is capable of cycling rapidly. By purchasing or using the RBT FRT, YOU acknowledge and assume personal responsibility and inherent risk, including but not limited to LIABILITY, INJURY, LOSS, DAMAGE, or DEATH resulting from improper use, misuse, installation, or abuse of the FRT.
WAIVER OF RIGHTS: By purchasing and/or using the RBT FRT, YOU waive and release any claims for damages, indemnity, or reimbursement against RBT for any claims, fines, or damages imposed upon you due to the use of the FRT.
Furthermore, YOU agree to release RBT (including its affiliates, contractors, officers, and employees) from any and all claims, actions, damages, liabilities, losses, costs, and expenses (including attorney fees) for death, injury, property damage, or any other loss arising from the purchase or use of the RBT FRT. By purchasing and using the FRT, you agree to limit RBT’s liability to actual damages resulting from gross negligence or willful misconduct. RBT shall not be liable for any special, incidental, punitive, or consequential damages.
INDEMNIFICATION: By purchasing or using the RBT FRT, YOU agree to accept responsibility for your use of the product, and any consequences, fines, or legal actions resulting from your use. You further agree to indemnify and hold RBT harmless for any claims made as a result of your use of the FRT.
TRANSFER OF PRODUCT: If you sell, lease, gift, or otherwise transfer the FRT to another individual (the recipient), YOU agree to ensure that the recipient is fully aware of, and agrees to, the terms outlined in this agreement. Failure to transfer the FRT in accordance with this requirement will result in liability being placed on you, the original buyer.
BINDING EFFECT: By purchasing or using the RBT FRT, you agree that this waiver will be binding upon you, as well as your heirs, personal representatives, beneficiaries, and assigns, and will inure to the benefit of RBT and its successors.
SEVERABILITY: If any provision of this waiver and release is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the extent necessary to make it enforceable.
GOVERNING LAW: This Waiver and Release will be governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action or claim related to this waiver shall be brought in the appropriate courts in Orange County, Florida.
DISPUTE RESOLUTION: Any controversy or claim arising out of or relating to the product, its design, functionality, or materials, or this contract, will be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. By agreeing to this provision, YOU waive your right to resolve disputes in court, including the right to a trial by jury. You also waive any right to participate in a class action lawsuit or arbitration.
ELECTION: If the conditions of this agreement are unacceptable to you, DO NOT PURCHASE THIS PRODUCT. If you have already purchased an RBT FRT and do not agree to these terms, please destroy the product, return it to your retailer, or transfer it in accordance with the terms outlined here.
ACKNOWLEDGEMENT: THIS IS A WAIVER AND RELEASE OF LIABILITY. YOU AGREE TO ALL OF THE PROVISIONS HEREIN AND UNDERSTAND THAT YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO THESE TERMS. BY PURCHASING OR RETAINING THIS PRODUCT, YOU INDICATE YOUR VOLUNTARY AGREEMENT TO THE TERMS OF THIS WAIVER AND RELEASE OF LIABILITY.
